Read this first — two things that matter more than the rest
⚠️ Rouse is not a medical or fitness product
Rouse is an alarm clock with a friction mechanic. It is not a medical device, not a
health app, not a fitness tracker, and not a sleep-therapy tool. It does not diagnose,
treat, cure, monitor or prevent any condition, and it gives no medical, health, sleep,
psychological or fitness advice. Step counts shown in Rouse exist only to unlock an
alarm; they are not a fitness measurement and are not accurate enough to be treated as
one. Nothing in the app is a substitute for advice from a qualified healthcare
professional. See HEALTH_DISCLAIMER.md.
⚠️ Do not rely on Rouse as your only alarm when something important depends on it
Rouse depends on the Android operating system, on your device's manufacturer power
management, on permissions you can revoke, and on your device being charged, switched on
and working. Any of those can prevent an alarm from sounding, and some Android device
manufacturers aggressively kill background apps in ways no app can fully prevent.Do not use Rouse as your sole alarm for anything safety-critical or
consequence-heavy — including but not limited to catching a flight, medication
timing, a shift where lateness endangers someone, on-call duty, exams, or any situation
where failing to wake could harm you or another person. Set a second, independent alarm
(a separate device or a hardware alarm clock). We are not liable for a missed alarm. See
section 9.
1. Agreement
These Terms of Use are a contract between you and Joseph Hagan, publishing as Binary Data Technology. By
downloading, installing or using Rouse, you accept them. If you do not accept them, do not
use the app.
If you obtained Rouse from Google Play, the Google Play Terms of Service also apply to
your download and any purchase. Where Google Play's terms govern the transaction itself
(payment, refund, cancellation), those terms take precedence over anything here that
conflicts.
2. Who may use Rouse
You must be at least 13 years old, or the minimum digital-consent age in your country if
that is higher (for example 16 in some EEA countries). If you are under 18, you should
have a parent or guardian's permission, and they should read the health disclaimer with
you.
Rouse is not designed for children and we do not direct it at them.
3. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and
use one copy of Rouse per device you own or control, for your own personal, non-commercial
use.
You may not:
- copy, redistribute, sell, rent, sublicense or lease the app;
- reverse-engineer, decompile or disassemble it, except to the extent that applicable law
expressly permits despite this restriction; - remove or obscure any copyright, trademark or proprietary notice;
- modify the app or create derivative works from it;
- use the app or any part of it to build a competing product;
- circumvent, or attempt to circumvent, the entitlement or licensing checks that control
access to paid features; - distribute a modified build of the app under any name.
We keep all rights we do not expressly grant. Rouse, its name, logo, design, source code
and content remain our property or that of our licensors.
4. Acceptable use
You agree not to:
- use Rouse in a way that breaks any law that applies to you;
- use Rouse while driving, cycling, or operating machinery (see section 6);
- attempt to interfere with, overload or attack any service the app connects to;
- use automated tools to fake sensor input in order to defeat mission verification — this
is not something we will pursue you for, but it voids any expectation that the app will
work as intended for you; - use Rouse to harass, coerce or set alarms on a device belonging to someone who has not
consented.
Rouse contains no user-generated public content, no social feed, no messaging and no way
to send anything to another user. Text you type into a typing mission stays on your
device.
5. What Rouse does and does not promise about missions
Rouse's mission mechanic is designed friction, not enforcement. Android provides no
supported way for an app to block the Home button, the Back gesture or the app switcher.
We therefore state plainly:
- Rouse can be circumvented. A determined user can leave the app, disable it,
force-stop it, uninstall it, or defeat step detection by shaking the phone in a
particular way. We make no claim that the app is cheat-proof or that its plausibility
checks are infallible. - The "Emergency stop" is always available. Every alarm screen offers a way to dismiss
the alarm without completing the mission. This exists for your safety — if you are
injured, unwell, in danger, or physically unable to complete a mission, use it. We will
never remove it, gate it behind a payment, or make it hard to find. - There is no paid way to skip a mission. Rouse Pro does not sell mission skips,
bypasses, or shortcuts. Emergency stop is free for everyone, forever. - Step counts are approximate. They depend on your device's sensors, which vary widely
in quality. Do not treat them as a fitness metric.
6. Physical activity, safety and the health disclaimer
Some Rouse missions ask you to walk or to shake the phone. That is physical activity, and
it happens immediately after waking, when you may be disoriented.
By using motion-based missions you confirm that:
- you are physically able to perform light activity such as walking around your home;
- you have considered whether to consult a doctor first, particularly if you have a heart
condition, a balance or mobility problem, low blood pressure, dizziness on standing,
epilepsy, a musculoskeletal injury, are pregnant, or take medication that affects
alertness or balance; - you will stop immediately if you feel pain, chest discomfort, dizziness, faintness or
shortness of breath, and use the Emergency stop; - you will not perform a mission while driving, cycling, on stairs in the dark, near
water, or while operating machinery; - you accept the ordinary risks of moving around, including tripping and falling.
Non-physical missions — arithmetic, typing a phrase, and repeating a memory pattern —
are always available as alternatives. You never have to choose a motion mission. If a
motion sensor is unavailable or you deny the activity permission, Rouse automatically
falls back to a non-motion mission.
You use Rouse's physical missions at your own risk. See
HEALTH_DISCLAIMER.md, which forms part of these Terms.
7. Rouse Pro — subscriptions and purchases
7.1 What is free
The free tier is genuinely usable and is not time-limited: alarms, all mission types,
streak tracking, the home-screen widget, and Emergency stop. There are no ads on any
tier.
7.2 What Pro adds
Rouse Pro unlocks up to two years of history, a larger streak-freeze budget with faster
rewards, every alarm tone on the device, and adaptive mission difficulty. Pro does not
unlock a way to skip missions, and does not
remove ads (there are none to remove). The exact contents of Pro may change over time;
material reductions to what an active subscriber already paid for will be notified in
advance.
7.3 Plans
Rouse Pro's United States launch prices are:
- an annual plan at US $39.99 per year, which may include a 3-day free trial for eligible new customers;
- a weekly plan at US $9.99 per week, with no trial; and
- a discounted first annual period at US $19.99, which may be shown after you dismiss the
paywall if Google Play reports that your account is eligible, followed by renewal at the
standard US $39.99 annual price.
Prices are shown in your local currency in the app before you buy, inclusive of taxes
where Google Play applies them. Prices may differ by country and may change; any change to
a recurring price is handled through Google Play, which will notify you and, where
required, ask you to accept it before it takes effect.
7.4 Auto-renewal
Subscriptions renew automatically. You may cancel through Google Play before renewal; your
subscription normally remains available through the end of the already-paid period. Google Play
shows the controlling renewal date and terms before purchase and in your subscription settings.
If you do not cancel before that renewal, Google Play may charge your payment method for the next
period at the then-current price and continue doing so each period until you cancel.
7.5 Free trial and conversion to paid
If a plan includes a free trial, the trial runs for the stated period (3 days for the
annual plan). If you do not cancel before the trial ends, the trial converts
automatically into a paid subscription and you are charged the first period's price.
- The trial length, the price after the trial, and the renewal frequency are shown on the
purchase screen before you confirm. - Cancelling during the trial keeps your access until the trial's end and prevents the
charge. - Trials are generally limited to one per Google account, as determined by Google Play.
7.6 How to cancel
Cancel through Google Play, not through us — we cannot cancel a subscription on your
behalf:
Google Play Store app → profile icon → Payments & subscriptions → Subscriptions →
Rouse → Cancel subscription.
Cancelling stops future renewals. You keep Pro access until the end of the period you have
already paid for. Deleting the app does not cancel a subscription.
7.7 Refunds
Purchases are processed by Google, and refunds are handled under Google Play's refund
policy (https://support.google.com/googleplay/answer/2479637). We do not process
payments and generally cannot issue a refund directly. Request refunds through Google Play
in the first instance.
If you are a consumer in the UK or the EEA, you may have a statutory right to withdraw
from a digital-content purchase within 14 days. That right can be lost once download or
performance begins with your express consent and acknowledgement, which is how Google Play
delivers in-app purchases. Nothing in these Terms removes a statutory right you have that
cannot lawfully be excluded.
7.8 Entitlement verification
Rouse verifies entitlement with Google Play. If verification cannot complete (for example
you are offline), a previously verified active entitlement remains valid for a grace
window so that a paying user is never locked out of their own alarm. We may end that grace
window when verification shows the entitlement has genuinely lapsed.
8. Your data
Our handling of your data is described in PRIVACY_POLICY.md, which
forms part of these Terms. In summary: Rouse stores your data on your device, collects
nothing by default, and offers optional, off-by-default Firebase backup, analytics and
crash reporting.
Backups are your responsibility. Rouse stores your alarms and history locally. If you
lose, wipe, reset or damage your device, or uninstall the app, that data is gone unless
you enabled cloud backup or exported a file yourself. We are not responsible for lost
local data.
9. Disclaimers
To the fullest extent permitted by law:
- Rouse is provided "as is" and "as available", without warranties of any kind, express
or implied, including implied warranties of merchantability, fitness for a particular
purpose, accuracy, and non-infringement. - We do not warrant that Rouse will be uninterrupted, error-free, or that any given alarm
will fire at the intended time. Alarm delivery depends on the operating system, device
power management, manufacturer software, permissions, battery state and factors outside
our control. - We do not warrant the accuracy of step counting, motion detection or any plausibility
check. - We make no health, fitness, sleep-quality, productivity or behaviour-change claims. Any
benefit you get from Rouse is your own doing.
10. Limitation of liability
To the fullest extent permitted by applicable law:
- We are not liable for indirect, incidental, special, consequential, exemplary or
punitive damages, or for loss of profit, revenue, data, goodwill, opportunity, or for
the consequences of a missed, delayed, silent or failed alarm — including missed
flights, missed appointments, missed medication, lost income, disciplinary action, or
academic consequences. - We are not liable for injury arising from performing a physical mission, to the extent
the law permits us to exclude that liability. - Our total aggregate liability to you for all claims relating to Rouse is limited to the
greater of (a) the amount you paid us for Rouse in the 12 months before the event giving
rise to the claim, or (b) USD 50.
Nothing in these Terms excludes or limits our liability for death or personal injury
caused by our negligence, for fraud or fraudulent misrepresentation, or for any other
liability that cannot lawfully be excluded or limited. If you are a consumer, you have
statutory rights that these Terms do not affect, and some jurisdictions do not allow
certain exclusions — in which case those exclusions do not apply to you.
11. Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your
breach of these Terms or your unlawful use of the app. This does not apply where the claim
arises from our own breach or negligence, and it does not apply to the extent your local
consumer law prohibits it.
12. Suspension and termination
You may stop using Rouse at any time by uninstalling it. That does not automatically
cancel a subscription — see section 7.6.
We may suspend or terminate your licence if you materially breach these Terms, in
particular by attempting to circumvent entitlement checks or by distributing a modified
build. Where practical and lawful we will warn you first. Termination does not entitle you
to a refund of a period already used, but does not remove your right to a refund you are
otherwise legally entitled to.
We may discontinue Rouse entirely. If we do, we will give reasonable notice in the app and
will not take new subscription payments after that notice.
13. Changes to these Terms
We may update these Terms. If a change materially affects your rights, we will notify you
in the app before it takes effect, and where it affects a subscription you already hold we
will do so before your next renewal.
Continuing to use Rouse after a change takes effect means you accept the updated Terms. If
you do not accept them, stop using the app and, if you have a subscription, cancel it
through Google Play.
The "Last updated" date at the top shows when these Terms last changed.
14. Third-party terms
- Google Play: your download, purchases, renewals and refunds are subject to the
Google Play Terms of Service. - Firebase: if you enable optional cloud features, Google processes that data as
described in the Privacy Policy. - Apple: N/A — Rouse is an Android application.
15. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard
to its conflict-of-laws rules. The state and federal courts located in Hampden County,
Massachusetts have non-exclusive jurisdiction over disputes.
If you are a consumer, this does not deprive you of the protection of the mandatory
consumer-law rules of the country where you live, and you may be able to bring proceedings
in your own country's courts.
Before starting formal proceedings, please contact us at support@binarydatatechnology.com so we can try
to resolve the matter.
These Terms do not require mandatory arbitration and do not include a class-action waiver.
16. General
- Severability: if a provision is unenforceable, the rest stays in force.
- No waiver: not enforcing a right does not waive it.
- Assignment: you may not assign these Terms. We may assign them as part of a sale or
reorganisation of the business, without reducing your rights. - Entire agreement: these Terms, the Privacy Policy and the Health Disclaimer are the
whole agreement between us about Rouse. - Language: English is the controlling language of these Terms.
